Curious.. Is talking about the spell dat that comes via patching covered under NDA?

If it goes to live, it's not under any NDA.
If you're talking about, say, the SPDAT that you get from patching BETA, then yes.
If you're talking about, say, the SPDAT that you get from patching BETA, then yes.
