It's cheating technically.
THey are saying that we see them as different colors, but we don't. We all honestly see them as exactly the same colors as each other. This is most evident when you look at the second illusion as it doesn't use an overlay.
The thing we are getting different between the two is our TRANSLATION of the colors, because our mind is realizing that there is a tint applied to the area which includes that color (shadow in first one and yellow/blue fields in final), so when we ask our mind "What color is this object?" It sees both of them as the same color, but in answer to our question about the "object" within the picture, it has to remove the tint and then answers us with "White here, black there" and "This is yellow, that is grey."
Being able to see the two as the same colors without blocking out the information that there is a tint on the area would be a sign of a very art focused mind (right brain I believe that is).
Still damn cool, but the main trick here is convincing us that we are seeing two different colors when in actuality we are just applying the knowledge of tinting. It's sorta like showing someone who just lost depth perception a picture of an apple on the table next to a real apple and laughing when they can't tell the difference.
